General Provisions

1.1. This Privacy Policy describes how Foxtail, SIA, registration number 40203558748, Riga, Bruknas iela 8 – 150, LV-1058 (hereinafter referred to as the “Data Controller”), collects, processes and stores personal data obtained from its customers and individuals who visit the website (hereinafter also referred to as the “Data Subject” or “You”).

1.2. Personal data is any information about an identified or identifiable natural person, i.e. the Data Subject. Processing is any operation that is performed on personal data, such as obtaining, recording, organizing, using, consulting, modifying, deleting or destroying them.

1.3. The controller of your personal data is Foxtail, SIA, to whom you are contacting in a specific case to purchase a product or receive a service.

1.4. The Data Controller complies with the applicable data processing principles and ensures that personal data is processed in accordance with applicable law.

Collection, processing and storage of personal data

2.1. The Data Controller collects, processes and stores personally identifiable information primarily through the website, visiting the store and e-mail.

2.2. By visiting and using the services offered on the website, you agree that the information provided is used and managed in accordance with the purposes specified in this Privacy Policy.

2.3. The data subject is responsible for ensuring that personal data is correct, accurate and complete. Providing false information is considered a violation of our Privacy Policy. The data subject is obliged to immediately inform the Data Controller of any changes to personal data.

2.4. The Data Controller is not liable for any losses suffered by the Data Subject or third parties due to falsified personal data.

Processing of Customer Personal Data

3.1. The Data Controller may process the following personal data:
First and last name;
Date of birth;
Contact information (e-mail address and/or telephone number);
Transaction data (time of transaction, purchased goods, delivery address, price, payment information, etc.).

3.2. In addition to the above, the Data Controller has the right to verify the information provided using publicly available registers.

3.3. The legal basis for the processing of personal data is Article 6 (1) (a), (b), (c) and (f) of the European Union General Data Protection Regulation:
(a) The data subject has consented to the processing of personal data for one or more specific purposes;
(b) Processing is necessary for the performance of a contract to which the Data Subject is a party, or in order to take steps at the Data Subject’s request prior to entering into a contract;
(c) Processing is necessary for compliance with a legal obligation to which the Data Controller is subject;
(f) Processing is necessary for the legitimate interests pursued by the Data Controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the Data Subject which require protection of personal data, in particular where the Data Subject is a child.

3.4. The Data Controller shall store and process the Data Subject’s personal data as long as at least one of the following criteria is met:
The personal data are necessary for the purposes for which they were collected;
As long as the Data Controller and/or the Data Subject can exercise their legitimate interests in accordance with external provisions, such as the exercise of an objection or the establishment of legal claims;
As long as there is a legal obligation to retain the data, such as the Accounting Act;
As long as the Data Subject’s consent to the relevant processing of personal data is valid, unless there is another legal basis for the processing of personal data.
When the conditions listed in this paragraph no longer exist, the storage period for the Data Subject’s personal data expires, and all relevant personal data are irreversibly deleted from computer systems and electronic and/or paper documents containing the relevant personal data, or these documents are anonymized.

3.5. In order to fulfill its obligations towards you, the Data Controller has the right to transfer your personal data to its partners, data processors, who perform the necessary data processing on our behalf, for example, accounting specialists, courier service providers, etc.
The Data Processor is the Data Controller.
Payment processing is provided by the payment platform makecommerce.lv, therefore our company provides the necessary personal data for payment execution to the platform owner Maksekeskus AS.
Upon request, we may disclose your personal data to state and legislative agencies in order to protect our legal interests, filing and defending legal claims.

3.6. When processing and storing personal data, the Data Controller implements organizational and technical measures to ensure the protection of personal data against accidental or unlawful destruction, alteration, disclosure and other unlawful processing.

Rights of the Data Subject

4.1. In accordance with the General Data Protection Regulation and the laws of the Republic of Latvia, you have the right to:

Access your personal data, receive information about its processing, request a copy of your personal data in electronic format and the right to request the transfer of these data to another data controller (data portability);

Request the correction of inaccurate, incorrect or incomplete personal data;

The deletion of your personal data, except in cases where the law requires the retention of the data;

Withdraw your previously given consent to the processing of your personal data;

Request the restriction of the processing of your personal data;

Final provisions

5.1. This Privacy Policy has been developed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), as well as the applicable laws of the Republic of Latvia and the European Union.

5.2. The Data Controller has the right to make changes or additions to this Privacy Policy at any time and without prior notice. Changes come into effect upon their publication on the website www.foxtail.lv.
